These Terms and Conditions apply to the purchase of tickets to, and attendance at, Hopkins Creek Festival ("the Event"), operated by Hopkins Creek Events Pty Ltd (ACN 619 422 516), held at 1939 Delacombe Way, Tatyoon VIC ("Event Grounds").

By purchasing a ticket or attending the Event, you agree to be bound by these Terms and Conditions and any other guidelines published on our website (www.hopkins-creek.com), including the "How To Hopkins" guide. If you do not agree, you must not purchase a ticket or attend the Event.

We may update these Terms and Conditions at any time by publishing the revised version on our website. Continued attendance or ticket purchase constitutes acceptance of any changes.

1. Definitions

1.1 Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth).

1.2 Claim means any allegation, debt, cause of action, liability, proceeding, suit or demand of any nature whether present or future, actual or contingent.

1.3 Consumer has the meaning given under the Australian Consumer Law.

1.4 Event IP means all intellectual property developed or used to promote the Event.

1.5 Loss means any cost, expense or damage (including legal costs on a full indemnity basis), whether direct or indirect.

1.6 Prohibited Items includes but is not limited to glass, pets (except guide dogs), weapons, flares, fireworks, cooking gear, N2O chargers, illegal drugs, and generators.

1.7 Prohibited Behaviour includes but is not limited to theft, vandalism, harassment, environmental damage, unauthorised fires, trespassing, anti-social conduct, disregarding safety instructions, disrupting local communities, damaging equipment at the Event, and failing to respect the Event Grounds or its surroundings.

1.8 Representative means any person acting on behalf of Hopkins Creek Events, including directors, staff, contractors, volunteers, and agents.

2. Ticketing and Entry

2.1 The Event is strictly 18+. You must present a valid photo ID (driver's licence, passport or proof of age card) upon entry.

2.2 Entry requires a valid ticket, which can be displayed digitally or printed.

2.3 Tickets are sold exclusively via Humanitix. Ticket limits may apply and excessive orders may be cancelled.

2.4 Entry permits attendance during the dates and times set by the organiser.

2.5 Upon arrival, a wristband will be issued and must be worn at all times. No wristband = no entry.

2.6 Tickets may only be resold at face value and at the sole cost of the ticket holder via Tixel. Other resale methods are prohibited.

2.7 Unless otherwise authorised by us, tickets may not be re-sold or given away for promotional or commercial purposes.

2.8 We are not responsible for lost, damaged or stolen tickets.

2.9 You agree to receive communications via our mailing list related to the Event and affiliated events.

3. Event Changes, Refunds and Cancellations

3.1 All sales are final. Refunds will not be issued for change of mind.

3.2 We may alter the venue, lineup, amenities, or schedule without notice. Subject to your rights under Australian Consumer Law, these changes do not entitle you to a refund.

3.3 If the Event is cancelled due to events outside our reasonable control (a "Force Majeure Event"), such as fire, flooding, adverse weather, natural disasters, pandemic, or government rulings:

3.3.1 If cancellation occurs prior to commencement, 90% of the ticket face value (excluding fees) will be refunded. 10% will be retained as a cancellation fee to cover pre-committed costs.

3.3.2 If cancellation occurs on the scheduled event dates, no refunds will be provided.

3.4 Refunds (where eligible) must be requested within 14 days of the announcement. After this period, you agree to accept any rescheduled dates.

3.5 No refunds will be issued for refusal of entry or removal from the Event due to non-compliance with these Terms.

4. Conduct, Behaviour and Site Rules

4.1 You must behave respectfully toward all attendees, staff, volunteers, and the local community. Anti-social, aggressive, threatening, or discriminatory conduct will not be tolerated.

4.2 You must comply with all lawful and reasonable directions from Event staff, security, and other Representatives.

4.3 Prohibited Items are not allowed on site. Vehicles, bags, and personal belongings may be searched upon entry and at any time during the Event.

4.4 Possession of Prohibited Items may result in refusal of entry, removal from the Event, or confiscation of the item(s) without liability. Confiscated items will not be returned.

4.5 Prohibited Behaviour includes, but is not limited to: harassment, abuse, or assault (physical or verbal); vandalism or destruction of property; theft or attempted theft; trespassing or entering restricted areas; lighting fires or using open flames; unsafe behaviour; disruption of performances or operations; littering; use or distribution of illegal substances; intoxicated behaviour; ignoring signage; damaging equipment; or disrupting residents.

4.6 You may be refused entry or evicted without refund if: you engage in Prohibited Behaviour; you refuse to comply with a search; or you are subject to any active legal restriction that would prohibit your presence at the Event.

4.7 Access is limited to designated public areas only. Entering staff or restricted zones without permission may result in removal or legal action.

5. Intellectual Property and Media Consent

5.1 All Event branding, design, content and materials remain the property of Hopkins Creek Events or its licensors.

5.2 By attending, you consent on a non-revocable basis to being photographed or recorded. We may use these images or recordings through all media, in perpetuity, royalty-free.

5.3 Media professionals must obtain written approval to film or photograph.

5.4 Professional-grade recording equipment is not permitted without consent.

6. Risk Acknowledgement

6.1 You attend the Event at your own risk.

6.2 You warrant that you are medically and physically fit to participate.

6.3 We may arrange medical treatment or evacuation if deemed necessary. You bear any associated costs.

7. Liability and Indemnity

7.1 Nothing in these Terms limits your rights under the Australian Consumer Law.

7.2 To the extent permitted by law:

7.2.1 We and our Representatives are not liable for any Loss arising from your attendance.

7.2.2 You release us and our Representatives from all Claims relating to the Event.

7.3 You indemnify us against any Claim or Loss arising from:

7.3.1 Injury, death, or property damage caused by your acts or omissions;

7.3.2 Your breach of these Terms and Conditions.

8. General

8.1 These Terms form the entire agreement.

8.2 We may assign our rights without notice.

8.3 If any part of these Terms is invalid, the rest remains in effect.

8.4 These Terms are governed by the laws of Victoria, Australia.
